The Servitude Question - September 2026

Tonight, you will be asked to approve two servitudes relating to the project.

Infrastructure Servitude

Under the current arrangement, the co-owners remain responsible for the costs associated with the repair and maintenance of the aqueduct, sewer system, and drainage infrastructure located beneath the street, including in the event of a malfunction or pipe failure.

The proposed infrastructure servitude would transfer responsibility for the repair and maintenance of this infrastructure to the City of Laval, thereby removing this potential financial liability from the co-owners.

Reduced Right-of-Passage Servitude

The second servitude concerns a substantially reduced pedestrian right of passage, located entirely along one side of the project, adjacent to the Groupe Sélection senior residence.

Rather than creating a passage through the project, it provides only a short pedestrian connection between the existing walking path on Étienne-Lavoie and the waterfront path that continues toward the senior residence.

This significantly limits the impact of the right of passage on the project while maintaining the required pedestrian connection.

It does not cut through the project, and its impact on the property has been eliminated.

Plans for Approval

The attached plans provide:

  • a visual representation showing the location and extent of the two servitudes; and
  • the corresponding legal technical plan defining the servitudes for approval.

The objective tonight is straightforward: transfer responsibility for the municipal infrastructure away from the co-owners and substantially reduce and relocate the pedestrian right of passage so that its impact on the project is minimized.
